1. Acceptance of Terms
By accessing, browsing, or using the Pistolo Brand Defense Center (the "Site"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use ("Terms") and by the Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you ("User") and the Pistolo organization ("Pistolo," "we," "us," or "our"). If you are accessing the Site on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
Pistolo reserves the right to modify these Terms at any time without prior notice. Modifications become effective upon posting to the Site. Your continued use of the Site following the posting of modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes.
2. Purpose and Scope of the Site
This Site is operated exclusively as a brand protection and intellectual property enforcement resource for the Pistolo.com digital ecosystem. The Site provides information about Pistolo's registered intellectual property rights, verification tools for confirming the authenticity of Pistolo-branded digital properties, mechanisms for reporting suspected brand violations, and transparency records of enforcement actions taken by the Pistolo enforcement team.
The Site is not a commercial platform and does not offer goods or services for sale. No commercial transaction may be conducted through this Site. Any communication purporting to offer Pistolo products or services through this Site or any email address associated with this Site is fraudulent and should be reported to abuse@pistolo-support.site immediately.
3. Intellectual Property Rights
All content on this Site, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Pistolo or its content suppliers and is protected by applicable intellectual property laws, including copyright, trademark, and database rights. The compilation of all content on this Site is the exclusive property of Pistolo and is protected by applicable copyright law.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for its intended purpose — namely, to verify the authenticity of Pistolo-branded properties and to report suspected violations. This license does not include the right to: (a) reproduce, distribute, or publicly display any content from the Site; (b) modify or create derivative works based on Site content; (c) use any data mining, robots, scraping, or similar data gathering tools; (d) download or copy account information for the benefit of another party; or (e) use the Site for any commercial purpose not expressly authorized by Pistolo in writing.
The Pistolo name, logo, and all related marks, product names, and slogans are trademarks of Pistolo and may not be used in connection with any product or service without the prior written consent of Pistolo. All other trademarks not owned by Pistolo that appear on this Site are the property of their respective owners.
4. Zero-Tolerance Policy for Brand Misuse
Pistolo maintains an absolute zero-tolerance policy with respect to unauthorized use of its brand, trademarks, copyrights, and digital assets. Any person or entity found to be engaging in brand impersonation, domain squatting, content cloning, phishing, or any other form of unauthorized brand exploitation will be subject to the full range of available legal remedies, including but not limited to: injunctive relief; claims for actual damages, statutory damages, and punitive damages where applicable; attorney's fees and costs; and referral to law enforcement authorities for criminal prosecution where applicable law provides for criminal penalties.
Pistolo does not issue informal warnings for commercial infringement. Upon confirmation of a commercial violation, the matter is immediately referred to legal counsel for action. The enforcement team does not engage in negotiation prior to the initiation of formal legal proceedings for confirmed commercial violations. Parties who receive a formal takedown notice or legal demand from Pistolo are strongly advised to seek independent legal counsel immediately.
5. User Submissions and Violation Reports
By submitting a violation report through this Site, you represent and warrant that: (a) the information provided is accurate and complete to the best of your knowledge; (b) you have a good-faith belief that the reported use is not authorized by the rights holder, its agent, or applicable law; and (c) you understand that knowingly submitting a materially false report may result in legal liability, including liability for damages, costs, and attorney's fees incurred by the reported party as a result of the false report.
Violation reports submitted through this Site become the property of Pistolo and may be used in enforcement proceedings, shared with legal counsel, disclosed to law enforcement authorities, and retained indefinitely as part of the enforcement record. Pistolo does not guarantee that any particular enforcement action will be taken in response to a submitted report, and the decision to pursue enforcement is at Pistolo's sole discretion.
6. Disclaimer of Warranties
The Site and all content, information, and materials available through the Site are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Pistolo does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Pistolo does not warrant the accuracy, completeness, or timeliness of any information on the Site.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Pistolo and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of or inability to use the Site, even if Pistolo has been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, Pistolo's liability is limited to the maximum extent permitted by law.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the European Union and applicable national law, without regard to conflict of law principles. For users located in the United States, these Terms are additionally subject to applicable U.S. federal law, including the Lanham Act and the DMCA. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of courts of competent jurisdiction in the EU, provided that Pistolo reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction worldwide.
Pistolo's enforcement rights are global in scope and are not limited by the jurisdiction of any particular court or legal system. Pistolo actively pursues enforcement actions in all jurisdictions where violations occur and where applicable law provides a remedy.
9. Severability and Entire Agreement
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, consistent with the original intent of the parties. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pistolo with respect to your use of the Site and supersede all prior or contemporaneous communications and proposals, whether oral or written.
